1. Our Services

New Generation Builds provides residential and commercial construction and remodeling services, which may include:

Whole house remodeling

Structural and cosmetic renovations

Design-build and project management services

All services are provided based on availability, site conditions, permitting requirements, and the details outlined in a written agreement.

2. Estimates, Proposals & Agreements

Any estimate, proposal, or scope of work we provide:

Is informational until confirmed in a signed written agreement

Is based on information available at the time of consultation or site visit

May change if project scope, materials, site conditions, or requests are adjusted

Final pricing, timelines, and deliverables are defined in the signed contract to ensure clarity for both parties.

3. Project Changes & Adjustments

Construction projects can evolve. Changes may occur due to:

Client requests or design refinements

Hidden or unforeseen site conditions

Inspection or code requirements

Material availability

When changes are needed, we’ll communicate them clearly. Additional work outside the original scope may require a written change order and could affect cost or schedule.

4. Permits, Codes & Inspections

Unless otherwise stated in writing:

We handle required permits for contracted work

All work is completed in accordance with applicable building codes

Inspection schedules, permit approvals, and third-party timelines may influence project schedules and are outside our direct control.

5. Client Responsibilities

To keep projects running smoothly, clients agree to:

Provide accurate and timely project information

Allow reasonable access to the property during scheduled work

Secure pets, valuables, and personal belongings during construction

Communicate decisions, approvals, and questions promptly

Delays related to access, approvals, or decision-making may impact timelines or costs.

6. Payments & Scheduling

Payment schedules and milestones are outlined in the signed agreement.

Timely payments help us keep your project moving efficiently.

If payments fall behind, work may be paused until the account is brought current, as allowed by the agreement.

7. Warranties & Guarantees

New Generation Builds stands behind its work and provides:

A 2-year workmanship warranty on qualifying work, unless noted otherwise

Manufacturer warranties on applicable materials

Warranties do not cover:

Normal wear and tear

Damage caused by misuse, neglect, or modifications by others

Client-supplied materials

Conditions beyond our control, such as severe weather or structural issues unrelated to our work

Warranty concerns should be reported promptly so we can address them appropriately.

8. Project Photos, Videos & Testimonials

We may take photos and/or videos of a project before, during, and after completion for documentation, quality control, training, and portfolio purposes.

Marketing and promotional use:

Project photos, videos, and testimonials may be used on our website, social media, marketing materials, or advertisements.

We avoid sharing sensitive personal information and do not intentionally display private documents, mail, or security-related details.

Address and identifying details:

Full street addresses will not be published without permission.

If you prefer that identifiable exterior shots or features not be shared, you may request this in writing.

Opt-out option:

You may opt out of marketing use at any time by emailing newgenbuilds@gmail.com. Opting out does not affect services already provided.

9. Website Use & Content

All website content, including text, images, logos, and branding, is owned by New Generation Builds or used with permission.

Website content is provided for general informational purposes only and does not constitute a binding offer or contract. Users agree not to misuse the website or interfere with its functionality or security.

10. Limitation of Liability

While we strive for high-quality workmanship and clear communication, to the fullest extent permitted by law, New Generation Builds will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of use, lost profits, or diminished value.

Our total liability for any claim related to the services, whether in contract, warranty, or otherwise, will not exceed the amount paid to New Generation Builds for the specific services giving rise to the claim.

This limitation does not apply where prohibited by law.

11. Termination of Services

Either party may terminate services in accordance with the signed agreement and applicable law. In the event of termination:

The client remains responsible for payment for work completed, materials ordered, and approved change orders through the termination date.

Deposits, progress payments, and outstanding balances will be handled according to the contract terms.

If work is paused or terminated due to non-payment or lack of property access, schedules may change and restart dates depend on availability.

Termination does not waive rights or obligations that accrued prior to termination.

12. Third-Party Products & Services

We may install or recommend third-party products or coordinate with licensed subcontractors. Manufacturer warranties and third-party services remain subject to their own terms and conditions.

13. Resolving Concerns

We believe most concerns can be resolved through open communication. Clients are encouraged to contact us promptly so we can work toward a fair and timely resolution. Additional dispute procedures may be outlined in the signed agreement.

14. Governing Law

These Terms & Conditions, and any services provided by New Generation Builds, are governed by and interpreted in accordance with the laws of the State of Washington, without regard to conflict-of-law principles.

15. Changes to These Terms

Your use of our website and services is also governed by our Privacy Policy, which explains how personal information is collected and handled.

16. Updates to These Terms

These Terms & Conditions may be updated periodically. Updates will be posted on this page with a revised effective date. Continued use of our website or services reflects acceptance of the current terms.
